TechRev Health, Inc., on its own behalf and its affiliate TechRev, LLC (“TRH”, “we”, “us” “our”), is committed to maintaining the privacy of your Personal Information. This Privacy Policy describes the types of Personal Information we collect from visitors of our public websites and mobile applications and our practices for using, maintaining, sharing, and protecting it. It also describes the rights and choices you may have with respect to your Personal Information and how you may contact us about our privacy practices. For visitors who register and log-in (“Users”) to the password-protected and secure portions of our Website for the purposes of utilizing our DocVoice platform and corresponding services (“Secure Platforms”), additional privacy notices will apply. The information collected and stored by TRH or added by our Users into such Secure Platforms in connection with our Users’ use of the DocVoice platform and associated services may be considered Protected Health Information (“PHI”) and/or medical information and is governed by applicable state and federal laws that apply to that information, for example the Health Insurance Portability and Accountability Act of 1996 (Public Law 104-191) and the Health Information Technology for Economic and Clinical Health Act (Public Law 111-5), and their implementing regulations (collectively, “HIPAA”). Please refer to Notice of Privacy Practices located at Notice of Privacy Practices for additional information about your PHI rights under HIPAA. For example but without limitation, if you have consented to importing data from your healthcare provider into the Secure Platform, you should review our Notice of Privacy Practices to understand how we use and disclose such PHI. TRH will not use or disclose information received from your healthcare provider for advertising, marketing, or other use-based data mining purposes and will not combine it with other data and will not sell it.

When using our Website, you may choose to interact with features from third parties that operate independently from TRH, such as social media widgets and links to third-party websites. TRH has no control over and is not responsible for the privacy practices of such third parties. This Privacy Policy does not apply to the extent TRH does not own or control any linked website or features you visit or use. We recommend that you familiarize yourself with the privacy practices of those third parties.

Privacy Policy is not a contract and does not create any contractual rights or obligations.

1. TYPES OF PERSONAL INFORMATION WE COLLECT

While using our Website, you may provide us with certain information about you. We or our advertising partners also may automatically collect information through the use of cookies and other tracking technologies (see below).

Personal Information that we collect through your use of the Website may include IP Address, Device ID, online identifier, mobile device information and contact information (if you provide us with such information). We may use that Personal Information and link it to Internet or other electronic network activity information, mobile app interactions and we may draw inferences about you from the information we collect. We may also collect your name, title, business contact information, phone number, date of birth, state, country, zip code, email address, or login identification information only if you provide us with such information directly to us when you begin registration to use a Secure Platform or complete a web form seeking more information.

We may also collect PHI and other healthcare-related information from you if you use a Secure Platform (including our DocVoice platform and its associated services) as well as such data generated from your or your healthcare provider’s use of our Secure Platform, such as your glucose, blood pressure, oxygen saturation, and other health readings; the date, time and device identifier associated with such readings; thresholds that you (or your healthcare provider) input into the Secure Platform or software apps and notifications triggered by such thresholds. It also includes contact information of any person that you designate to receive your PHI through functionality of a Secure Platform or Service, which will include your healthcare provider (see below how we share information with your designated recipients); contact information; information about the devices, internet service, IP address, and browsers that you use to access and use our Secure Platform; information about your settings and your activities associated with your use of our Secure Platform (e.g. how frequently you use our services and your user preferences); usernames, passwords, security answers, and location data you input into our Secure Platform; forms that you submit electronically through our Secure Services; and if you are a healthcare provider using the Secure Platform, any of the username and foregoing health information of any person for whom you order or pay for our Secure Platform.

2. HOW WE COLLECT PERSONAL INFORMATION

We may collect Personal Information using the following methods:

• Directly from you when you provide it to us (such as information you enter into web forms, inquiries, responses, activity on the Website, and during registration to use a Secure Platform).
• From third parties you have authorized to share information with us. For example, we collect information about you from third parties when you integrate a third-party’s product into our software, integrate our products into a third-party’s software, or otherwise authorize a third-party data service to provide information about you to us. If you use our Secure Platform, we may also collect information about you from your healthcare provider.
• Automatically through tracking technologies (cookies, web beacons, log files), including over time and across third-party website or other online services, as well as through the peripheral devices (e.g., Samsung gives the user a device number that allows Samsung to contact and access the device from anywhere in the world, as long as there is an internet connection).

3. HOW WE USE YOUR INFORMATION

• Operate, maintain, supervise, administer, and enhance the Website, including monitoring and analyzing the effectiveness of content on the Website, aggregate site usage data, and other usage of the Website such as checking your eligibility and assisting you in completing the registration process.

4. HOW WE SHARE YOUR INFORMATION

We may share Personal Information with third parties in certain circumstances or for certain purposes, including:

• For business purposes: We may share your Personal Information with vendors and service providers, including our data hosting and data storage partners, analytics and advertising providers, technology services and support, and data security. We also may share Personal Information with professional advisors, such as auditors, law firms, and accounting firms. We may disclose your name, email address, date of birth, phone number, and address if you provided it to us via a form on the website or during an incomplete or failed registration to service providers.
• With your provider and other service providers when using the Secure Platform: We may share your Personal Information with your healthcare provider and other representatives that you designate to us when using the Website. YOU ARE RESPONSIBLE FOR DETERMINING YOUR REPRESENTATIVES AND PROVIDING US ACCURATE INFORMATION FOR YOUR REPRESENTATIVES. We do not verify the accuracy of any information you provide when you designate a representative to receive your Personal Information. You must provide to us any applicable consents or authorizations that we request for any representative that you designate to us as an intended recipient of your Personal Information. If your healthcare provider or other designated representative is an entity, you should consult that person’s terms of service, privacy policy, and other provisions of their website and services as they apply to your Personal Information that is transferred to such representative. • With your direction or consent:  We may share your Personal Information with other third parties if you request or direct us to do so. This includes your use of social media widgets on our Website.
• With affiliates within our corporate group: We may share your Personal Information with any affiliates within our corporate group.
• With Service Provider: We may share your Personal Information with third-party entities, business partners, or others that provide services or products, or perform functions, on our behalf so that we may operate and manage our business, including but not limited to providing: the Secure Platform and peripheral devices, including service providers that provide data hosting, storage, retrieval, and analytical services; administrative functions and process, including but not limited to email services and shipping services; legal functions and processes; control and compliance processes; and staff augmentation.

8. CHILDREN’S PRIVACY

10. RETENTION OF PERSONAL INFORMATION

When determining the appropriate retention period for Personal Information, we take into account various criteria, such as the amount, nature, and sensitivity of the Personal Information; potential risk of harm from unauthorized use or disclosure; purposes for which we process your Personal Information; whether we can achieve those purposes through other means; and business operations and legal requirements. Because we maintain our Website to protect from accidental or malicious loss and destruction, residual copies of your Personal Information may be retained in our backup and archival systems for a limited period of time, after which the information will be automatically deleted or put beyond use where deletion is not possible.

Collection of Personal Information

We collect Personal Information as defined by the CCPA, which is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal Information does not include de-identified or aggregate information; publicly available information that is lawfully made available from federal, state, or local government records; and information covered by certain sector-specific privacy laws. TRH collects Personal Information categories, including

• Identifiers, Internet Protocol (IP) address, online identifier, device identifier. We may collect your name, email address, date of birth, phone number, and address only if you provided it to us via form on the website or during an incomplete or failed registration.
• Commercial information, business contact information if you have provided it to us via a form (such to register for services, obtain more information, request a demo, request an RFP) on the website, including name, company name, physical address, email address, telephone, and fax number; information on actions taken on our Website, which may include information about preferences and behavior that we collect on our Website or purchase from third parties in order to target consumers for digital advertisements or to personalize content we deliver on our Website.

As required under applicable law, we may take steps to verify your request before we can provide Personal Information to you, delete Personal Information, or otherwise process your request. To verify your request, we may require you to provide your name, physical address, email address, contact information, and information about your account or previous transactions with us. If you have only visited our public Website and did not provide any Personal Information to us via a web form or through the registration process, we will need you to provide us with your IP address or device ID in order for us to determine if we have that information. We will not be able to determine if we have your IP address or device ID from your name, physical address, email address, contact information, or account information.

Consistent with California law, if you choose to exercise your rights, we won’t charge you different prices or provide different quality of services unless those differences are related to the value of your information.
